Terms and Conditions — Comstay

These Terms and Conditions (“Terms”) govern your use of www.comstay.group (the “Website”) and any services provided by Comstay (“Comstay”, “we”, “us”, “our”). By accessing the Website, booking a call, requesting an audit, or purchasing services, you agree to these Terms.

If you do not agree with these Terms, please do not use the Website or our services.

2. Scope of Services

Comstay provides professional services related to short-term rental performance, including (but not limited to):

  • Airbnb listing optimization (titles, descriptions, keyword strategy, structure)
  • Pricing strategy recommendations and performance guidance
  • Guest experience design (templates, house guide structure, review strategy)
  • Calendar and minimum-stay strategy recommendations
  • Visual guidance and photo retouching recommendations (or coordination when applicable)
  • Ongoing performance monitoring and strategic adjustments
  • Support as an Airbnb co-host if agreed with the client

Important: Unless explicitly agreed in writing, Comstay does not provide on-site services such as cleaning, maintenance, check-in/out, repairs, or physical property management.

3. Eligibility and Client Responsibilities

By using our services, you represent that:

  • You are at least 18 years old
  • You have the legal right to manage or authorize changes to the listing(s) you submit

Client responsibilities include:

  • Providing accurate information about the property and listing
  • Ensuring local compliance with laws, regulations, permits, and HOA/condominium rules
  • Maintaining an on-site cleaning/operations team (if required for the listing)
  • Implementing agreed changes promptly (when client-side action is required)
  • Maintaining access permissions necessary to deliver services (e.g., co-host access)

4. Co-Host Access and Third-Party Platforms

If required to deliver the services, the client may grant Comstay access to Airbnb as a co-host. Comstay does not request Airbnb login credentials.

Use of Airbnb or any third-party platform (Airbnb, Google, Meta, Calendly, WhatsApp, etc.) is subject to those platforms’ own terms and policies. Comstay is not responsible for third-party platform outages, changes, restrictions, or policy enforcement.

5. Fees and Payment Model (15%)

A. Performance Fee

Unless agreed otherwise in writing, Comstay charges a performance fee equal to 15% of the revenue generated by the listing(s) under collaboration.

Revenue definition (default): gross accommodation revenue as recorded on the platform (nightly rate + cleaning fee if collected through the platform), excluding taxes collected and remitted by the platform and excluding security deposits where applicable.

If you prefer a different definition (e.g., excluding cleaning fee or using payout-based revenue), it must be agreed in writing.

B. Invoicing and Payment Terms

  • Fees are invoiced on a regular cycle agreed with the client (typically monthly)
  • Payment is due within seven (7) days of the invoice date
  • Late payments may result in service suspension until the balance is settled

C. No Setup Fees (unless specified)

Comstay generally operates with no setup fees, unless a specific one-time project scope is agreed in writing (e.g., deep audit, multi-unit onboarding, custom deliverables).

6. No Guarantee of Results

Comstay uses best-practice methods and professional experience to improve listing performance. However, you acknowledge that results depend on multiple external factors, including but not limited to:

  • Market demand and seasonality
  • Competition and local pricing environment
  • Property condition, amenities, and guest experience
  • Review history and rating
  • Local regulations and platform policy changes
  • Client implementation speed and operational execution

For these reasons, Comstay does not guarantee specific outcomes (e.g., revenue, occupancy, ranking position, or review scores).

7. Intellectual Property

All materials created by Comstay (strategies, templates, written content, audits, documents, processes, and recommendations) remain the intellectual property of Comstay unless otherwise agreed.

You are granted a non-transferable license to use the deliverables for your own listing(s) and internal business purposes.

You may not resell, redistribute, or publish Comstay materials as standalone products without written permission.

8. Confidentiality

Both parties agree to keep confidential information private, including business details, pricing, strategies, performance data, and any non-public information shared during the collaboration.

This obligation survives the end of the collaboration.

9. Client Content and Accuracy

If you provide photos, text, listing data, or other content, you confirm you have the right to use and share that content. You are responsible for ensuring that listing statements are accurate and compliant with local laws and platform rules.

Comstay is not responsible for claims that arise from inaccurate information supplied by the client.

10. Prohibited Use

You agree not to:

  • Use the Website for unlawful purposes
  • Attempt to disrupt or compromise Website security
  • Copy, scrape, or reverse-engineer Website content without permission
  • Misrepresent identity or authorization over a listing
11. Cancellation and Termination

A. Client Cancellation

You may cancel services at any time by written notice to contact@comstay.com.

Cancellation becomes effective at the end of the current calendar month, and fees remain payable through that month.

B. Comstay Termination

We may terminate or suspend services if:

  • You breach these Terms
  • Payment is overdue
  • Cooperation or access is not provided in a way that prevents service delivery
  • We reasonably believe continued work could expose us to legal or platform risk

C. Effect of Termination

Upon termination:

  • Access permissions (e.g., co-host) may be removed
  • Any outstanding fees become immediately due
  • Confidentiality obligations continue
12. Refund Policy

Unless otherwise required by law or agreed in writing, fees paid for services already delivered are non-refundable.

If a billing dispute arises, you agree to contact us first at contact@comstay.com and attempt resolution in good faith.

13. Disclaimer (Website Content)

All information on the Website is provided for general informational purposes and does not constitute legal, financial, or tax advice.

You should consult qualified professionals regarding regulatory compliance, taxation, insurance, and legal obligations related to short-term rentals in your location.

14. Limitation of Liability

To the maximum extent permitted by law:

  • Comstay shall not be liable for indirect, incidental, special, or consequential damages
  • Comstay’s total liability for any claim related to services shall not exceed the fees paid to Comstay during the three (3) months preceding the event giving rise to the claim

Comstay is not responsible for:

  • Platform account actions (suspension, restrictions, listing removal)
  • Guest behavior, property damage, theft, or operational incidents
  • Local regulatory enforcement or penalties
  • Third-party outages or system failures
15. Privacy

Personal data is processed in accordance with our Privacy Policy and Cookie Policy available on the Website.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of Costa Rica, without regard to conflict of law principles.

Any disputes shall be subject to the competent courts of Costa Rica, unless mandatory consumer protection laws provide otherwise.

17. Changes to These Terms

We may update these Terms from time to time. The latest version will be posted on this page with an updated “Last updated” date. Continued use of the Website or services after updates constitutes acceptance of the revised Terms.
